Legal argumentation, like argumentation generally, occurs against a background of shared understanding and competence. This view, inspired by Kuhn's understanding of scientific reasoning, is in stark contrast to more traditional ‘rule-following’ accounts of legal argumentation. Below I consider reasons to reject the more traditional view of legal reasoning in favor of a roughly Kuhnian account of legal reasoning and conclude by raising skeptical questions about the cogency of legal reasoning when the tacitly accepted background conditions that make it possible are (...) not critically examined. Many legal disputes turn on scientific, especially statistical, evidence. Traditionally scientists have accepted only that statistical evidence which satisfies a 95 percent (or 99 percent) rule — that is, only evidence which has less than five percent (or one percent) probability of resulting from chance.The rationale for this rule is the reluctance of scientists to accept anything less than the best-supported new knowledge. The rule reflects the internal needs of scientific practice. However, when uncritically adopted as a rule for admitting (...) legal evidence, the seemingly innocuous 95 percent rule distorts the balance of interests historically protected by the legal system. In particular, plaintiffs in toxic tort and employment discrimination suits are effectively held to a heavier burden of proof in showing that their injuries were more probably than not caused by the defendant's actions. The result is that too many victims of toxic torts or employment discrimination cannot win legal redress for their injuries. (shrink)

It is often assumed that believing that p for a normative reason consists in nothing more than (i) believing that p for a reason and (ii) that reason’s corresponding to a normative reason to believe that p, where (i) and (ii) are independent factors. This is the Composite View. In this paper, we argue against the Composite View on extensional and theoretical grounds. We advocate an alternative that we call the Prime View. On this view, believing for a normative reason (...) is a distinctive achievement that isn’t exhausted by the mere conjunction of (i) and (ii). Its being an achievement entails that (i) and (ii) are not independent when one believes for a normative reason: minimally, (i) must hold because (ii) holds. Apart from its intrinsic interest, our discussion has important upshots for central issues in epistemology, including the analysis of doxastic justification, the epistemology of perception, and the place of competence in epistemology. This paper considers the place of reasons in the metaphysics of epistemic normativity and defends a middle ground between two popular extremes in the literature. Against members of the ‘reasons first’ movement, we argue that reasons are not the sole fundamental constituents of epistemic normativity. We suggest instead that the virtue-theoretic property of competence is the key building block. To support this approach, we note that reasons must be possessed to play a role in the analysis of central epistemically normative (...) properties, and argue that the relation of possession must be analyzed in terms of competence. But while we diverge with reasons-firsters on this score, we also distance ourselves from those who deny reasons any important role in epistemology. For we maintain that possessed reasons do help to ground deontic facts in the epistemic domain (e.g., facts about what one epistemically ought to believe, may believe, or is justified in believing). Indeed, we present an argument that the possession of sufficient epistemic reasons is necessary and sufficient for propositional justification, and that proper basing on such reasons yields doxastic justification. But since possession and proper basing are themselves grounded in competence, reasons are not the end of the explanatory road: competence enables them to do their work, putting them—and us—in the middle. We argue for a novel view of suspending judgment properly--i.e., suspending judgment in an ex post justified way. In so doing we argue for a Kantian virtue-theoretic view of epistemic normativity and against teleological virtue-theoretic accounts.

We argue that we can avoid epistemic dilemmas by properly understanding the nature and epistemology of the suspension of judgment, with a particular focus on conflicts between higher-order evidence and first-order evidence.

Augustine of Hippo strongly influenced western theology, but he has often been accused of over-emphasizing the unity of God to the detriment of the Trinity. In Augustine and the Trinity, Lewis Ayres offers a new treatment of this important figure, demonstrating how Augustine's writings offer one of the most sophisticated early theologies of the Trinity developed after the Council of Nicaea. Building on recent research, Ayres argues that Augustine was influenced by a wide variety of earlier Latin Christian traditions (...) which stressed the irreducibility of Father, Son and Spirit. Augustine combines these traditions with material from non-Christian Neoplatonists in a very personal synthesis. Ayres also argues that Augustine shaped a powerful account of Christian ascent toward understanding of, as well as participation in the divine life, one that begins in faith and models itself on Christ's humility. Recent writers claim that responsibilist virtue epistemology courts skepticism, owing to the fact that most of us lack the virtues it deems necessary for justified belief and knowledge. A powerful version of this objection is the challenge from situationist social psychology pressed by Alfano (2012, 2013) and Olin and Doris (2014). This paper develops a new version of responsibilism that is immune from this objection, and shows that this view has many advantages over other forms of virtue epistemology. My responsibilism (...) dispenses with the ubiquitous but (I argue) mistaken idea that responsibilist virtue properties must be understood in terms of character traits. My view parallels an often overlooked form of virtue ethics suggested by Thomson (1997) that some situationists (e.g., Harman (2001)) have praised. That form shares with other forms the thought that virtue properties are normatively fundamental, but it adds that act-attaching ones are prior to person-attaching ones, and require no backing by character traits. Far from being an ad hoc retreat position, I argue that this view is independently attractive. (shrink)

Many epistemologists treat rationality and justification as the same thing. Those who don’t lack detailed accounts of the difference, leading their opponents to suspect that the distinction is an ad hoc attempt to safeguard their theories of justification. In this paper, I offer a new and detailed account of the distinction. The account is inspired by no particular views in epistemology, but rather by insights from the literature on reasons and rationality outside of epistemology. Specifically, it turns on a version (...) of the familiar distinction in meta-ethics between possessing apparent normative reasons (which may be merely apparent) and possessing objective normative reasons. The paper proceeds as follows. In §1, I discuss the history of indifference to the distinction between rationality and justification in epistemology and the striking contrast with meta-ethics. I introduced the distinction between apparent reasons and possessed objective reasons in §2 and provide a deeper basis for it in §3. Anger, disgust, elevation, sympathy, relief. If the subjective experience of each of these emotions is the same whether elicited by moral or nonmoral events, then what makes moral emotions unique? We suggest that the configuration of moral emotions is special—a configuration given by the underlying structure of morality. Research suggests that people divide the moral world along the two dimensions of valence (help/harm) and moral type (agent/patient). The intersection of these two dimensions gives four moral exemplars—heroes, villains, victims and beneficiaries—each (...) of which elicits unique emotions. For example, victims (harm/patient) elicit sympathy and sadness. Internalism holds that epistemic justification is determined by what is internal to the mind, not by facts about the mind-independent world. This paper introduces and defends a new kind of internalism that is rooted in rationalist ideas that have been neglected in recent epistemology, despite inspiring internalist projects in cognitive science. Ignoring rationalist insights has, I argue, damaged the prospects for internalism, by needlessly saddling internalists with empiricist burdens. Internalists can refuse these burdens by accepting a better philosophy of mind. (...) Rather than looking to 17th century rationalists, I look to Kant, and especially his idea that normativity is grounded in the constitution of agency and mind. A Kantian approach can avoid stock objections to internalism, I argue, and can also capture all the alleged benefits of externalism. The paper is structured as follows. In §2, I get back to basics and consider more ways to satisfy the core internalist template than have become standard. I draw attention to rationalist insights about how normativity could be grounded in the constitution of mind, and hypothesize that if internalism respects these insights, some problems disappear. I develop this hypothesis in §3 with a Kantian view. I further defend this view in §4. I conclude in §5 by explaining why Kantian internalism answers the latest challenges to internalism. (shrink)

In lieu of an abstract, here is a brief excerpt of the content: Seven Poems NICOLAS CALAS (Translated by Avi Sharon) hellenizing surrealism: a greek door to europe Nicolas calas (Kalamares) may be considered merely a minor Greek poet, but he had a major global persona and influence. In the middle of the last century he played a catalyzing role in the international avant garde: He was a Zelig-like polemicist in three languages (Greek, French, and English) and across three cultural (...) capitals (Athens, Paris, and New York). But he always fought on a singular front: surrealism. Born in Lausanne in 1907, he grew up in Athens and by the later 1920s began to stand out in literary circles (he was over 6' 4") for his modernist if not revolutionary views. Starting from an interest in Freud and Marx, the subconscious and the revolutionary, Calas soon arrived at their natural synthesis—surrealism. Around the time when a distinctly Greek form of surrealist poetry emerged, with the 1935 publication of “Blast Furnace” by Andreas Embiricos, Calas was on his way to becoming its unofficial spokesman. He moved to the epicenter of the movement in Paris and with the 1938 publication of Foyers d’Incendie became the “most lucid and audacious” of founder André Breton’s acolytes, both prophet and demagogue of the group. Carried along in the current of European artists and thinkers leaving Europe for New York, he would continue the fight on the western wing of the faction (literally, coming to blows at a cocktail party with Clement Greenberg, representing the opposing Abstract Expressionist side). In 1942 he published another clarion pamphlet, Confound the Wise, giving the movement voice in English and befriending its most visible local supporters and practitioners, from Peggy Guggenheim to Marcel Duchamp. arion 27.1 spring/summer 2019 The Wyndham Lewis of the operation, Calas was a cross-border catalyst, evangelizing the role of surrealism as a liberating and generative force in modern literature and art. For him and other writers and poets, the weapon that would most effectively derange the reader’s habitual conformism into revelatory and revolutionary perception was the surrealist image, poetry’s lingua franca. For Greek practitioners it was completely natural for that magical representation to arise out of their god-infested, sun-filled landscape. Here they had a force that was both blinding and enlightening, penetrating and transformative, local and universal. For Calas, the primary echo or reflection of that essential image was the island of Santorini, referenced in several of the translations here (and reminiscent of his fellow national Nikos Gatsos’s use of the island of Amorgos in a similar context). It stood as the very symbol of fiery transformation, an image monstrous enough to shock the reader into a super-rational embrace of its own form of logic. This Hellenization of surrealism, like the Hellenization of modernism itself, was to become an important, transformative power in its own right. For many, the origin (and likewise, for many, the enclosing border ) of surrealism was France. “But it is French. It is their invention,” was how William Carlos Williams saw it, to his chagrin. Williams was convinced that the objective concentration on the image itself (“no ideas but in things”) could offer a salutary corrective to American poetry of his time. “It is the surrealists who have invented the living defense of literature,” he wrote in a 1929 essay. But for a poet so at one with the American Grain to be reconciled with surrealism’s ‘Francite’ he needed some way to cross the divide. His admiration for Calas’s work in clarifying and promoting the group’s ideas enabled the Greek poet to serve as a mediator, to allow the creative transference of its rebellious wisdom into Williams’s poetry. To borrow the title of one of his early American essays, Calas provided Williams a “Greek door to Europe.” In translating four of Calas’s French poems into English, published in 1941 with a frontispiece by the surrealist painter and magician Kurt Seligman, Williams leveraged Calas as the vehicle through which the “enabling foreignness” of surrealism could be grafted into the grain of his American modernist work, just as he set out on his magnum opus, Paterson. Past research has found that mere in‐group/out‐group categorizations are sufficient to elicit biases in face memory. The current research yields novel evidence that mere social categorization is also sufficient to modulate processes underlying face perception, even for faces for which we have strong perceptual expertise: same‐race (SR) faces. Using the composite face paradigm, we find that SR faces categorized as in‐group members (i.e., fellow university students) are processed more holistically than are SR faces categorized as out‐group members (i.e., students at (...) another university). Hence, holding perceptual expertise with faces constant, categorizing an SR target as an out‐group member debilitates the strong holistic processing typically observed for SR faces. (shrink)
